Privacy Policy

Last Updated: April 29, 2025

ConstructionBase.ai (“we”, “us”, or “our”) is committed to protecting the privacy of our users and customers. This Privacy Policy explains what information we collect, how we use and disclose it, and your choices and rights regarding your information. This policy applies to personal data collected through our website, applications, and services (collectively, the “Service”).

1. What Information We Collect

  • Contact and Identity Information: When you create an account or communicate with us, we collect identifiers such as your name, email address, phone number, and business address. We also collect any information you provide in your user profile.

  • Business and Project Data: You may upload or enter project details, bid or estimating data, scheduling information, and related business documents (collectively “Customer Data”). This data may contain information about your company, employees, or subcontractors. You remain the owner of all Customer Data.

  • Usage Data and Analytics: We automatically collect information about how you use the Service, such as pages visited, features used, logs, device and browser type, and IP address. We use cookies and similar technologies (e.g., session cookies, authentication tokens, analytics cookies) to collect this information. Cookies are used for user authentication, preference management, and analytics; you can manage cookie preferences via your browser or our consent banner.

  • Integrations and Third-Party Accounts: If you connect third-party apps (e.g., CRM or accounting software) to our Service, we may receive data from those services (subject to your authorization). We only request the minimum data necessary to enable the integration.

2. How We Use Your Information

We use collected information to provide, maintain, and improve the Service, including:

  • Service Delivery: To operate the platform (e.g., to schedule projects, generate estimates, and share information with authorized users or linked apps). We may use your data to train and improve our AI models only with your consent; otherwise, your Customer Data is not used to train models beyond what is needed to provide your specific outputs .

  • Communication: To respond to your inquiries, send account-related notices (such as technical notices, updates, security alerts, and support messages), and for customer support.

  • Security and Compliance: To protect against, identify, and prevent fraud, unauthorized activities, or security incidents. We employ encryption (TLS for data in transit, AES-256 for data at rest ) and other industry-standard safeguards.

  • Analytics and Improvement: To analyze trends, monitor usage, and improve the Service. For instance, we may analyze anonymized usage data to optimize performance.

  • Marketing and Legal Purposes: With your consent, we may send you newsletters or marketing communications. We may also use data as needed to comply with legal obligations, resolve disputes, and enforce our agreements.

3. Sharing of Information

  • With Your Consent: We may share your information with third parties when you request it, such as third-party vendors you link to (e.g., connecting a CRM or analysis tool).

  • Service Providers and Subprocessors: We engage trusted service providers to help operate the Service (e.g,. cloud hosting providers, payment processors, email service providers, and analytics platforms).

  • Legal Requirements: We may disclose personal information if required by law (e.g., to respond to a subpoena or court order), or if we believe it is necessary to protect our rights, property, or safety or that of others.

  • Business Transfers: If we are acquired or merge with another company, user data may be transferred to the successor entity. We will notify you and require that the successor assume our privacy obligations.

4. Data Retention and Transfer

We retain your personal information only as long as necessary to fulfill the purposes described above, comply with legal obligations, resolve disputes, and enforce our policies. In practice, we keep account and project data for as long as your account is active, plus a reasonable period thereafter (or as required by law), then we either delete or de-identify it.

International Users: Our servers are located in the United States, so data you submit may be transferred to and processed in the U.S.  If you are in the European Economic Area, the United Kingdom, or other regions with data transfer restrictions, we rely on lawful transfer mechanisms. These may include the EU–US Data Privacy Framework (for transfers between the EU/UK and the U.S.) or EU Standard Contractual Clauses (SCCs) for transfers from the EU to the U.S.  (The GDPR’s model clauses, or SCCs, are “contractual clauses adopted by the Commission” to safeguard data leaving the EU .)  We will execute any required Data Processing Addendum incorporating these protections upon request.

5. Your Privacy Rights

Depending on your location, you may have certain rights over your personal data:

  • GDPR (EU/UK) Users: If you are in the European Union, EEA, UK, or Switzerland, the GDPR applies. You have the right to access, correct, or delete your personal data, as well as to restrict or object to processing (for lawful reasons). You also have the right to data portability and to withdraw consent (where consent is the legal basis) at any time. To exercise these rights or for inquiries, you may contact us (see below).

  • CCPA (California) Users: If you are a California resident, the California Consumer Privacy Act may apply.  Under the CCPA, you have the right to know what categories of personal information we collect, to request access to your information, to request deletion of your personal information, and to opt out of any “sale” of personal information. In particular, the CCPA “grants consumers the right to delete personal information” and “opt out of the sale of their personal information”.  Although we do not sell data, you may also have the right to opt out of certain sharing for targeted advertising. If you wish to exercise a CCPA right, please contact us (see below). We will verify your identity before acting on any request.

We do not knowingly collect data from children under 18. If you believe we have personal data of a minor, please contact us, and we will delete it.

6. Cookies and Tracking Technologies

Our website and apps use cookies, web beacons, and similar technologies to enhance your experience.  We use session cookies to keep you logged in, preference cookies to remember your settings, and analytics cookies to measure usage and traffic patterns. We do not allow tracking for third-party advertising without your consent. Most web browsers allow you to control cookie preferences (e.g., to block or delete cookies). Please note that blocking cookies may impair the functionality of the Service.

7. Security of Data

We implement appropriate technical and organizational measures to protect personal data. This includes encryption at rest and in transit, firewalls, access controls, and regular security assessments. For example, all data transfers occur over TLS/SSL. We regularly back up data and use secure data centers in the United States. While we strive to protect your information, no system is completely secure. We cannot guarantee absolute security or that unauthorized access will never occur. You agree not to upload highly sensitive personal information (e.g., social security numbers, health information) to the Service.

8. AI and Automated Decision-Making

Our platform uses AI to automate certain tasks (e.g., generating estimates or schedules).  We process personal data through these AI systems as part of providing the Service.  In line with best practices, we disclose this use in our policy. You have the same rights (access, correction, deletion, etc.) with respect to data used by the AI as for any other data we process.

9. Third-Party Services and Links

The Service may contain links to third-party websites or services (for example, integration portals, app marketplaces, or news links).  We are not responsible for the privacy practices or content of those external sites.  Once you leave our Service, you should review the privacy policy of each site you visit.  We also allow integration with third-party services, but those services are independent, and their handling of your data is subject to their own policies.

10. Changes to This Policy

We may update this Privacy Policy from time to time (for example, to reflect new legal requirements or features). When we make significant changes, we will notify you by posting a notice on our website or sending an email. The “Last updated” at the top of this policy indicates when it was last revised. Continued use of the Service after changes indicates your acceptance of the updated policy.
